Overt Digital Marketing (ODM) Referral Program Terms and Conditions

 

  1. Program Overview
    The Referral Program (the “Program”) is an initiative by Overt Digital Marketing (the “Company”) to reward existing clients or individuals for referring new clients. By participating in the Program, you agree to comply with and be bound by the following terms and conditions.
  2. Eligibility

        To be eligible for this Program:

  • The referrer (the “Participant”) must be an existing client or approved individual in the Company’s network.
  • The referred business (the “Referral”) must not have previously engaged with the Company in any capacity.
  • The Referral must sign up for and continue with a minimum of three (3) months of digital marketing services provided by the Company.
  • The Participant must have received approval from the Referral to share their contact information with the Company.
  1. Program Incentive
  • The reward for a successful referral is $1,000, either as a deduction on the Participant’s next invoice or as a direct payment to the Participant, at their discretion.
  • The reward will be issued only after the Referral has completed three (3) full months of services with the Company and all relevant payments have been received by the Company.
  1. Payment Terms
  • If the Referral is deemed successful, the Participant will be eligible for payment within thirty (30) days after the Referral has completed three (3) months of services.
  • Payments will be made either as a credit on the Participant’s next invoice or via direct bank transfer, as agreed upon by both parties.
  • All payments are non-transferable and may not be exchanged for any other rewards or services.
  1. Referral Process
  • Participants must submit referrals by providing the Referral’s business name, contact person, and contact details via email only.
  • The Company reserves the right to independently verify the information provided and to reject any referrals deemed to be duplicates or not meeting Program criteria.
  1. Qualified Referral Requirements
  • A Qualified Referral is a business that signs a contract for digital marketing services with the Company and completes three (3) months of service.
  • The Referral must sign up within three (3) months of the initial referral date for the Participant to be eligible for the reward.
  • The Referral’s contract must be for a minimum service level of one digital advertising channel, like Google Ads, with an approximate monthly investment of $5,000, including fees and media spend.
  1. Limitations and Restrictions
  • Referrals made on behalf of your own business or businesses owned or operated by the Participant do not qualify.
  • The Program is void where prohibited by law and is subject to all federal, state, and local laws and regulations.
  • The Company reserves the right to disqualify any Participant if the Company has reason to believe the referral was made in bad faith or through prohibited means.
  1. Participant Responsibility
  • Participants are responsible for ensuring that they have the consent of the Referral to share their contact information with the Company.
  • Participants agree to conduct their referrals honestly and in good faith, and to refrain from any form of solicitation that might violate privacy or spam regulations.
  1. Program Changes and Termination
  • The Company reserves the right to modify, suspend, or terminate the Program at any time without prior notice.
  • Any changes to the Program will be effective immediately upon posting, and continued participation after such changes shall constitute acceptance.
  1. Disputes and Limitations of Liability
  • Any disputes arising from the Program shall be governed by the laws within the jurisdiction of Queensland, Australia.
  • The Company shall not be liable for any loss, harm, or damage arising from participation in the Program or from the use of any incentive, whether direct, indirect, or consequential.
  1. No Warranties
  • The Company makes no express or implied warranties concerning the Program or any benefit associated with it.
  1. Miscellaneous
  • The Company’s decision on any Program-related matters is final and binding.
  • These terms constitute the entire agreement regarding the Program, superseding any previous communications or understandings.
